Concealed Carry without a permit?

A friend of mine in florida has decided its ok to carry concealed lately without a permit...as a permit holder (Colorado) I feel like hes asking for trouble. What advise can be given to this guy?

if your friend is in Colorado he can legally carry a concealed handgun in his vehicle, home or his place of business w/out a permit IAW CRS 18-12-204

Here is the text of CRS 18-12-105

18-12-105. Unlawfully carrying a concealed weapon - unlawful possession of weapons.
(1) A person commits a class 2 misdemeanor if such person knowingly and unlawfully:
(a) Carries a knife concealed on or about his or her person; or
(b) Carries a firearm concealed on or about his or her person; or
(c) Without legal authority, carries, brings, or has in such person's possession a firearm or any explosive, incendiary, or other dangerous device on the property of or within any building in which the chambers, galleries, or offices of the general assembly, or either house thereof, are located, or in which a legislative hearing or meeting is being or is to be conducted, or in which the official office of any member, officer, or employee of the general assembly is located.
(d) (Deleted by amendment, L. 93, p. 964, § 1, effective July 1, 1993.)
(2) It shall not be an offense if the defendant was:
(a) A person in his or her own dwelling or place of business or on property owned or under his or her control at the time of the act of carrying; or
(b) A person in a private automobile or other private means of conveyance who carries a weapon for lawful protection of such person's or another's person or property while traveling; or
(c) A person who, at the time of carrying a concealed weapon, held a valid written permit to carry a concealed weapon issued pursuant to section 18-12-105.1, as it existed prior to its repeal, or, if the weapon involved was a handgun, held a valid permit to carry a concealed handgun or a temporary emergency permit issued pursuant to part 2 of this article; except that it shall be an offense under this section if the person was carrying a concealed handgun in violation of the provisions of section 18-12-214; or
(d) A peace officer, as described in section 16-2.5-101, C.R.S., when carrying a weapon in conformance with the policy of the employing agency as provided in section 16-2.5-101 (2), C.R.S.; or
(e) (Deleted by amendment, L. 2003, p. 1624, § 46, effective August 6, 2003.)
(f) A United States probation officer or a United States pretrial services officer while on duty and serving in the state of Colorado under the authority of rules and regulations promulgated by the judicial conference of the United States.

Please note that illegally carrying a concealed weapon is a class 2 misdemeanor in Colorado and like will not lead to a permanent loss of his RKBA.

That said, Show him the law and after that he's on his own

Or he could just open carry.

Is this friend carrying only in his car's glovebox or console (which is legal in Florida without a permit), or is he also carrying on his person? If so, encourage him to get a permit, assuming he's not a felon or is otherwise prohibited from owning firearms.
 
Thanks guys! Sounds like florida is cool w open carry...maybe ill recommend that until he get his cc permit figured out.
 
I am a Florida Resident.

If he gets caught without a permit the judge will put him under the jail.

CC laws here are pretty lax so just get a dang permit.

Tell him to start looking for an attorney now. Eventually he'll be making that call.

Has to be in a case or retention device type holster.
Can't be in the same area as registration.
Must be kept closed/secured depending on which state trooper you talk to.

Where in the law does it say that it can't be in the same area as the registration? I'm not disagreeing with you, I just haven't found it in the law so if you can point me to it I would appreciate it.

It really doesn't matter what the trooper thinks, it's what the law states
790.25(3)(L)A person traveling by private conveyance when the weapon is securely encased or in a public conveyance when the weapon is securely encased and not in the person’s manual possession;
Securely encased means:
790.001(17) “Securely encased” means in a glove compartment, whether or not locked; snapped in a holster; in a gun case, whether or not locked; in a zippered gun case; or in a closed box or container which requires a lid or cover to be opened for access.

I'm curious, people are assuming he has no permit, does he have a permit he just isn't carrying it with him?

If he does have a CCW permit and doesn't have it on him then it's only a $25 administrative fee. I'm guessing that the admin fee is because ccw info doesn't come up when an officer checks your driver's license info and must do a separate check for ccw.

So as you see the comments are based upon the reference to the Friend deciding to carry without a permit. Not a good idea anywhere.
