CCW Denied Today

Hello everyone. I need some help/direction.

22 years ago, I was arrested for 2nd degree assault and stealing over 150. I was on SIS probation for 5 years and never got into any other trouble.

I have purchased one firearm, obviously passed a background for it.

When I went through this ordeal, I thought for sure that since I was on SIS probation, I would only have an arrest record, with no convictions. But I get denied on my application for the CCW citing my arrests 22 years ago.

Any help or direction would be really appreciated.

Check your States process for appeals. Any time you're on probation you have to have a conviction not just an arrest. Also if you have never been in any other trouble check state law on sealing/expunging your records. Not sure if the can look at those for CCW in MO though. Good luck.

You have the option of applying or a permit through Florida. I was in the same situation. There is nothing you can do about it. Currently there are no options of expungement under current Mo law.

What skycop said. If you were able to buy a firearm obviously your charge wasn't a felony so you haven't lost your rights. And if you had, most states will not reinstate firearms rights that were lost due to a violent crime conviction. You can try appealing but my guess is that it will get denied as well until you have the conviction vacated from your record. That can take several months to a year so I suggest you find a good attorney that specializes in record vacation and get started ASAP.

There is nothing in the law that says where your permit has to be from. As long as you meet all the requirements and take the necessary training there is nothing stopping it. I am not a convicted felon, so I can buy any gun I want, but according to MO law if you have had an SIS for any reason, you can't get a MO permit. Florida laws are a little more reasonable for the requirements. Since Florida and MO have reciprocal agreements, they each honor the others permits. So it all works out. Certified instructors have to register with the county sheriffs in order to be recognized to teach in their areas. So everything is above board and legit, the way the law is written is kind of dumb, there is no reason why someone who made a mistake over 20 or more years ago and has retained their rights - someone who can VOTE, buy guns and pay taxes - shouldn't be able to lawfully carry. Especially if it was never drug, weapon, or violence related - but that is a whole different kind of soapbox moment for another time.....
