Can my wife use my weapon for protection

I recently had someone trying to break in my home while I was at work. My wife and 2 year old boy where there with my pit bull she sent IsiS (my pit) out and she got a piece of him before he got away...
Fast forward to my question say it happens again and she kills the bastard will she be lawfully charged.

We recently moved to Tampa,fl from Connecticut any information would be great

Would you ask the same question if she grabbed your hammer from your workshop and beat the intruder? If she's protecting herself from a life threatening situation, she's fine unless your state has a "duty to flee" clause in your legislation like PA used to have before it signed Castle Doctrine. I just noticed you said your are from FL. As long as FL doesn't get rid of their Stand your Ground laws, she's fine.

Let's put it another way though. Would you rather her be judged by 12 jurors after she protected herself and your little boy or would you rather see them both carried by six. They need to do what they need to do if the situation arises.

I have another question for you. Does she train with your gun? Is she accurate and well-versed with your gun? Why isn't your gun on you? Simpler question: why not get a gun for her?

She can use it to stop a threat.
 
Real Life in Arizona not too long ago. A youngster - think about 12 - was babysitting his siblings when bad guys broke in. He got his dad's pistol and shot one of them inside the house. Think the guy died. Obvious self defense of himself and the other kids. Maybe someone has accurate details on this incident.
 
Don't know about Florida but in NYS she cannot be charged with criminal use or possession of a weapon when using an illegal handgun within her own home for lawful self-defense. The law was written that way for precisley this reason. In NY laws on self-defense are separate from firearms. In NY she may use deadly force to stop or thwart a burglary or when there is the imminent use of force such as rape, kidnapping ,murder, arson or an assault of such depravity that significant injury will likely occur. In NY the law allows one to exercise this same level of force to protect another individual.

Check you state law or consult an attorney.
 
@the OP... A weapon is not used to "kill" as is stated in the title of your post. It is intended to be used as a tool for self defense and self preservation. If indeed you are Trolling the gun forums looking for a specified response, you will probably not find it here. (unless AutisM or Deepstare have a comment)

If you are not I would suggest taking a self defense class in FLA. Speak with an attorney who knows the laws and understand them before carrying any firearm. Your verbiage alone in your title could be enough to get you in trouble in a self defense situation.

No she can not use your firearm. Only you can kill someone with your weapon. Although if you can train your put bull to shoot then by law a dog is allowed to shoot a intruder. Women in Florida are not allowed to defend a home with anything except a cast iron frying pan and even then it must be larger the 8" in diameter but must not exceed 14" in diameter. The only other option is the driveway clause IF and this is not easy if she could get the guy in the driveway she is allowed to BACK over him with the family car remember though ONLY reverse if she goes over him in a forward gear your gonna be in for a long court battle. She is well trained on using a firearm.
Been trying to convince her to get her permit I left my 2nd firearm in the closet upstairs where she was at at the time she couldn't get to it

Isn't there a Bastard clause in the Fla Statutes concerning deadly force?
 
Maybe make sure she can shoot well and have her get her CCW? Have her keep a gun in a nightstand so it is available if she needs it? Make sure she realizes if the pit bull is mauling the guy she could accidentally shoot the pit bull? Install outside lights for night use?

Um...I can't see where you live, but chances are you don't need a permit to own a weapon...cuz, you know...it's America. So it doesn't matter if it's "your" weapon or your third cousin's.

Treo called this one early, and maybe right?
