Can I Open Carry in my own home?

Just curious if I am actually allowed to open carry while in my own home? If I answered the door for the UPS man, a solicitor, a neighbor, a cop, etc who this be a violation if they saw me wearing it?

My door does not have any side windows or peep holes so its pot luck every time I openthat door. Once a cop knocked on my door at 11:30 PM on a rainy night because my neighbors alarm system had went off. It's not like he banged and yelled "police, open up" but even if he had said it was the police, so could have a criminal.

I'm sure if I ever did open carry in my own home my neighbors would brand me a nut anyway.

I wouldn't worry about what the neighbors or anyone else thinks, it's your home to do with as you please (unless you live in Chicago or somewhere).
 
If you're in chicago you can open carry inside your home but you had better not even step a toe outdoors. It is illegal to carry in your own backyard or frontyard. Great city huh? But I'm sure you're not from Chicago otherwise the question would have been "Are guns legal to own?"
 
What about in my garage? I think I read somewhere that your garage wasn't considered inside your home. It was an article about a man who shoot a burglar in his garage and what later charged.

So if I ever answer the door and a cop is standing there and I have my S&W 9mm on my hip he won't tackle me or arrest me just for wearing it?
 
Check your state laws online. If you can't find a clear answer don't be afraid to contact your local sheriff's office or email your state's attorney general.
 
Yes, please check your local laws. I am from New Jersikstan, luckily I have annexed myself from there. I know that if your open carrying in your home, and one of your neighbors sees you, they can call the LEOS. Just be safe, make sure of the local laws, so you don't end up in any unnecessary problems.
 
Can only answer for Texas, but first, did you vote for Obama?? Texas anywhere on property under your control, don't give a crap what the neighbors or LEO thinks.

In Florida you can go armed openly or concealed in your home or place of business. If you live in an apartment or condo this only applies within the walls of your domicile, NOT the common areas. If you live in a single family dwelling you can carry openly or concealed on ALL the surrounding property that is actually deeded to the home. That includes the driveway, yard, buildings and structures situated thereon.

I suggest you acquire the book - " FLORIDA FIREARMS LAW, USE & OWNERSHIP " by: Jon H. Gutmacher, Esq. It is an entertaining read that explains Florida and Federal laws on firearms, weapons and self defense issues. It can be found at most gunshops and indoor shooting ranges in Florida.

in FLA as long as you possess a firearm legally you may OC it on your property. if you live in an apartment type place that means only within your 4 walls, if you own/rent a home it means anywhere on your property, but be aware of easements because what may seem to be yours may not be.

Do you really need to ask this? If it was illegal to have your gun in the open in your house, how would you clean it? Hide under a blanket in your basement?

I think you are actually just looking for some support or reassurance because you seem to want to open carry but are afraid of what others may think. For that, all I can say is dont let other people stop you from exercising your rights. If they think you are nuts, great. Opinions are like poop holes, everyone has one.
 
You're in Florida and not in Chicago. Therefore, you can do what you want while in the confines of your own home. If you wish to wear nothing else but your gunbelt on, then so be it. I wouldn't answer the door in that condition, then someone may say something. :bad: But I've answered the door with my gun on me everytime I answer the door. On a few occasions, it has been a cop, and the first thing I notice is their eyes go right to it. So what? It's my house, my rules.

I read in the Traveler's Guide to the Firearm Laws of the Fifty States that Florida is prohibited open carry in all "public" areas. You may want to check into whether you can open carry while out in your yard. I don't have the statute in front of me and do not wish to give erroneous information, but it looks like you may be fine in doing that as well.

Ditto on the above recommendation. I have a second home in Florida and Gutmacher's book is awesome.

By the "Esq" after his name, one can see he's a lawyer. Not just any ambulance chaser either, he's a bigtime 2nd Amendment guy.

Considering that firearms law is an area rife with stupid and confusing laws, and that misinterpreting them can lead to anything from a simple fine to a misdemeanor to a felony weapons charge, I really don't think there are any stupid questions.

My reply did not state "stupid" for one. As for knowing State Laws and your ability to own, possess, carry and or just have one in your home. I would HIGHLY suggest going to your applicable State/County/City/Parish ordinances and review what's written than post on some web site and await an answer..... Gee your Honor, I read it was OK on this really neat Web Site. Ya, OK, if that's your choice I would recommend REALLY HIGHLY that you retain an attorney NOW prior to going any further. (Oh and this is a really neat web site)
 
Check own state laws. In GA, we have an open carry law, so you can open carry anywhere, with the stated exceptions. We also have a Castle Doctrine.
