You will see articles and forum comments (Disqus forum) concerning this incident and comments about the forthcoming trial of the surviving individual.

I read a couple of the news stories regarding this tragic incident. My first impression is that if the victim was not Hispanic, the story would read differently. Instead of the story reading "one human being shoots and kills another" race is now involved. My question is, why did Olivera show his pistol in the first place? That is the point of no return in my eyes. Also, as a relatively new comcealed carrier, to me, that is one dilemma I struggle with. I never want to end up in the situation where I should have drawn earlier. Also, I have resigned myself that I will never get in a verbal or physical confrontation again. I either walk away or the situation is such that I must draw. Scary stuff for sure.

"Carrying' should have a very calming effect on one. No need for those run of the mill transgressions to upset you. The consequences could be too great. I think that the quote "An armed society is a polite society" is better understood as CKaiser55 smartly points out through his would be actions in the future " Also, I have resigned myself that I will never get in a verbal or physical confrontation again. Don't know about other states but brandishing is not good you will see my gun only if necessary, if I pull it I am already in a bad situation, walk away works for me while keeping alert.

Brandishing can be the point of no return.

A incident in my town went bad when a stupid squable in a Kroger parking lot over who gets to go through the stop sign first caused a man to lose his life. This man brandishes his gun to a retired LEO who in turn took the brandishing as a threat, stepped out of his vehicle and emptied his magazine in to this persons vehicle. I believe the man tried to intimidate the wrong person!

Hey kaiser: Liked your answer--well said and I look forward to other replies you may make on the forum. I tend to think that being a latino had a lot to do with this, particularly, after the final execution-type shot to the head, the tow truck guy "apparently said" feliz navidad. Only witnesses are the dead man's relatives where story of "brandishing vs brandishing and then pointing" give one cause to doubt their truthfulness. Hey that is what the trial will be about. IMO, all the shots, except for the last one to the head while the victim is on ground and defenseless, could easily be called self defense because of the brandishing/pointing of firearm by victim. That last shot will send him away for 30 years.
