Boy Suspended For Merely Saying 'Gun'

An 11-year-old boy who hopes to become a Navy SEAL was suspended from a Maryland school after he used the word ‘gun’ in a conversation on board a school bus.
The sixth-grader at Northern Middle School in Owings was talking with a group of friends about the Sandy Hook Elementary school massacre when the bus driver overheard the conversation.
“He said, ‘I wish I had a gun to protect everyone from the bad guys,’’ said Bruce Henkelman, the boy’s father. “He wanted to be the hero.”
Henkelman told Fox News that his son was interrogated by the principal and a deputy sheriff – without their knowledge or permission.
“The principal told me if you say the word gun in my school – you will face a ten day suspension,” he said.
The incident happened just after the Sandy Hook shootings. Henkleman said he finally decided to speak out after a 5-year-old boy in their county was suspended for 10 days after he brought a toy cap gun onto a school bus.
Since the incident happened a day before winter break, the principal reduced the suspension to one day. But the family was ordered to complete an ‘intrusive’ four page questionnaire and the deputy sheriff said he would have to search their home --- without a warrant.
“But he was emphasizing that it warranted a 10-day suspension,” he said.
Robin Welsh, the deputy superintendent for school system, confirmed to Fox News that the incident occurred. She also said there was misinformation about the case. However, she declined to go into any details citing federal and local confidentiality laws.
Welsh did point out that the principal of the middle school did nothing wrong.
“The principal followed our policies and procedures and absolutely did handle it in an appropriate manner,” she said.
Henkelman told Fox News that he is outraged over his son’s treatment at the hands of the school.
“I keep telling him that he did nothing wrong,” he said. “At the very least the principal owes him an apology. Our personal rights were violated.”
Henkelman, a retired Navy veteran, said his son is an honors student who pitches for the local baseball team. And the boy wants to be a Navy SEAL.
“That’s the context of the comments he made on the bus,” he said. “He wants to be a hero.”
“He’s infatuated with the Navy SEALS,” he said. “He thinks they’re great – how they go and save the world. The context was to protect people just like the police department does with their guns.”
After Henkelman picked up his son from school, the deputy sheriff said he would need to search their home.
“I said, by what authority and he said that he had to make sure the house is clear of guns,” he said.
The deputy arrived at their home 15 minutes later armed with a four-page questionnaire.
“I was uncomfortable answering the questions,” he said. “But I was told if I don’t fill this form out – he would not be allowed back in school.”
The questions covered topics ranging from mental health to how many guns and weapons the family owned.
“They were very intrusive questions,” he said.
At some point, the deputy said he had to search the home. They got as far as the kitchen when Henkelman decided to feel uneasy.
“I asked him to leave,” he said. “The deputy became agitated and said he would get a search warrant. I said that’s what I needed.”
After the deputy left, Henkelman called the sheriff’s department. He was told over the phone that officers would not be searching his home.
The deputy later returned to complete the four-page document.
Henkelman said he’s speaking out because he never got answers from the school district.
“When I tried to get to the bottom of this – they refuse to answer any of my questions,” he said.” I called the director of transportation and he would not put anything in writing. I told him that was very cowardly.”

Does anyone else see the real problem in America? We're creating a society of little pansies that are not ready for the real world. Look at how we're raising them. Little league; we don't keep score, there are five outs to an inning, everyone who plays gets a trophy. The same with soccer. We teach socialism in school and expect rewards without earning it. These kids are not prepared for life. Well, in real life we keep score. There is competition. The wolf is readily at the door. How do we prepare these kids for reality if not through life experiences? How do they react when they someday get fired from a job? Crybaby society... from coast to coast.

Be nice to dismiss this as a bazaar one-of-a-kind story, but alas it's one of many. We expect children to think like adults, while adults think like children. The deputy should have knocked on the father's door, apologized and walked away.

It's difficult to even comprehend how irrational American's have become in a mere two generations. The young have no concept of time, but fifty years is a short time in the great scheme of things. About 1959 my parents bought me what was to become a well-worn cowboy outfit complete with hat, boots, vest, spurs, and of course a single action fire cracker pistol with holster belt. I was five or six. And cops and robber was the game of many days.

In the midst of the game a Reading police car pulled up to the curb (to do paperwork? rest? who knows?). Needless to say, I was the robber and he was the cop, so I pulled out my cap-gun and let him have it. I can still see him laughing in his patrol car. I walked up to his window and told him in whatever words, "you were shot so you're suppose to fall down." So he played along and rolled over in his seat.

Now imagine the same event happening in 2013? What have they done to our Country?
 
Expect more and more of this stuff folks. Glad Mr. Henkelman recovered his wits and told the sheriff's deputy to leave. I would not have allowed him in without a warrant. I also would not have answered the "four-page questionnaire," and would have hired a lawyer to bring suit against the school district if they didn't allow my son back in. Easy for me to say though. Lawyers are 'effin' expensive, and family fiscal reality may make that option untenable.
 
It is truly disgusting how the country has evolved into gun hating crybabies. I was just talking to my oldest son about CC, and he said he did not know if he could get used toit, to which I replied, after a week or so, you feel naked without your gun. However, he works in a secure Govt. facility, so he would leave it at home more than carry it. I too played cops and robbers, and cowboys and indians with locala officials as a child, and they enjoyed as much as I did.
 
So if your son utters the word gun then you get a visit from the sheriff so they can make sure you do not have any guns in the home? what if you do have a gun in the home? Since your son knows the word gun and uses it in a sentence this then disqualifies you from excercising your 2A right? Solution: To prevent these thought criminals from using language like this we have to make sure the education system is holding everyone back from reaching their full intelectual potential by putting people in defined boxes of identity, giving people only one or two choices when it comes to everything from entertainment to politics, encourage the use of "newspeak", running our schools in the same mannor that our prisons are run, and finally we need to get the state to step in and act as the parents.... Wait, this is already happening.
 
The damn schools need to stay out of how we raise our children! They're here to teach not enforce their morals on the kids and us. If I have guns in my house thats my business. If they want to come in they better have a search warrant! I'm not one of their students! They damn sure don't have any authority over me.
That cop overstepped his bounds with the search but if he let him then he has no one to blame but himself. You have to know your rights and not let the authorities take them from you.

The five or six-year-old would be buried with his body riddled with bullet holes fired at him by a "peace officer" who was equipped more like a soldier on patrol in the Afghanistan mountains than the helpful servant of The People his predecessors were when you and I were comin' up.

Great story, but no less sad due to the melancholy nostalgia all us old guys pine for.

BTW, the real Hopalong and Topper did a roping and horse-tricks show on the playground when I was in the third grade. Thanks for a second happy reminder of nostalgic days gone by.

Ok.. my thoughts on current school systems..

1) go to the school, talk with the teachers and principles.. read the rules/etc.. IF you yourself could not live under those rules/deal with that stuff.. Then why make your kids suffer through it?
2) Find things out about the school, talk with the kids, ask them questions and collate the answers - If you derive a consensus that says the school is a dictatorship of moronic ineptitude.. Pull your kids out and start to consider homeschooling..
3) find like minded parents.. group together.. start your own school, founded by, populated with like minded people to you..
4) urge the friends/family/other advocates of gun rights/etc to band together and make a demand of the "public" school system to change..

Otherwise.. Honestly if you let your kids stay in public schools, without being involved/interested and knowledgeable of the teachers/rules/etc.. Then enjoy how screwed up your kid will become as they get deeper and deeper into the crap that is public education system... REMEMBER NO KID LEFT BEHIND = dumb everything down so no-one fails!..

The other option.. is to constantly talk with your kids and make sure that you correct any Bull crap the teachers/etc push onto your kids..
And dont think its just someone elses schools that do it.. Doesnt need to be the whole school can be just one teachers influence that ruins things for your kids future.

I'm glad I work in a school system in PA... shoot, I use firearms as examples in my lessons when I teach about projectile motion, recoil, momentum, and energy.

This kind of crap burns me up, because it does give teachers and educational systems that do things right a bad name.

I'm glad I work in a school system in PA... shoot, I use firearms as examples in my lessons when I teach about projectile motion, recoil, momentum, and energy.

This kind of crap burns me up, because it does give teachers and educational systems that do things right a bad name.

There shouldn't be "Zero Tolerance" in school, there is no such thing in the real world. Theres always the exception to the rule. Just the way it is.

You do not allow anyone in your home and you do not complete a four-page form. The family has the right to remain silent... the very basis of our legal system. No law was violated here. The family is entitled to due process under the law. The family is entitled to constitutional protection against illegal search. If there are no convictions there can be no consequences. If the school won't let the child back you immediately sue the district for violating the child's right to an education under state law. Hire a tutor and claim the costs as consequential or compensatory damages. If EVERYONE would do this the insane behavior becomes quite unaffordable for educators. PUSH THE SYSTEM TO ITS BREAKING POINT.

They're trying to put the cart before the horse. Get the family to fill out the form even though they know very well no laws were broken. Then hold the family accountable for what information they include in the form.

I'd like to think that my town wouldn't have anything like this happen, but who knows how soon that'll change. The school administration that's there now is still the same when I left and the majority of the town is a pro-gun crowd. But had this have happened in my town, and had I have been that deputy, I couldn't have done the search myself. So probably in order to keep his 4th and 2nd amendments intact, and to keep my superiors (or whoever told him to search the house) happy, I would have driven to his house, knocked on his door and said "Mr. Henkelman, between you and me, I thoroughly searched your entire house and found absolutely nothing of concern. As far as that 4-page document goes, I would just write whatever answers will make the school happy and let your son back in school. Have a blessed day." And that would be the extent of my 4th amendment intrusion.

I have absolutely no doubt what I would have done. I would have invited the deputy watch me burn the questions. Then ordered him off my property. Next I would have called my atty. If I needed funding I would call the NRA regarding the suspension. No way that rule survives a freedom of speech challenge. AND the school bus is not in the school. All else failing my kid gets the 10 day suspension.

NO way, absolutely NO WAY I would go along with that intrusion!

Time to organize folks if this happens in your town
 
Exactly what I would expect from Maryland. When I lived in PA, we would drive 90 miles west to go south and avoid going through Maryland to get to Virginia to fish and hunt. Even back then it was a despicable state run by left wing nut jobs.

The father needs a lawyer to sue the school and the Sheriff for violating the kids 1A just for starters. Unfortunately the court system in Maryland is a s screwed up as the schools and law enforcement.

Teach your kids about the right to remain silent in the face of pressure. Don't answer no matter how much they threaten. The child needs to continuously repeat "I want my parents, NOW!"

Regarding the questionnaire? Here's your toilet paper. Regarding the search? Get the f--- off my property unless you have a warrant.

People need to start suing school districts when rights are violated and when kids are suspended without cause. Those kids are being denied their education as provided by law.
