Been arrested 3 times in my life...

I had a CCW permit around the year 2000 and let it lapse.

I have been arrested twice since then, but both times charges were dismissed.

Both arrests involved domestic disturbances, my wife and I were arguing...

During the first arrest my 45 acp was removed from my home even though it was not used, brandished, or in any way connected with the disturbance.

This gun has since been returned to me by the county sheriff.

And no, I have not beaten my wife.

I have NEVER been convicted of any crime.

Will this affect my recently applied for INDIANA CCW permit?

Thanks!

You sound like you attract trouble. Knowing that, even if legal, do you think its wise to carry? The trouble you attract/create could go from misdemeanor to felony really quickly if you lose your cool and have a gun at your disposal.

@OtisM

I carried for several years previously with no issues.

I appreciate your concern.

My wife and I have since reconciled our differences.

I am not a trouble maker, or seeker.

I was arrested in 2005 because my wife and I had been arguing, and the police asked me to leave for the evening. I stated that I had no where to go, and they elected to arrest me.

In 2012 I was arrested after I called the police. He stated I was uncooperative. I was released from jail a few hours later. The prosecutor dropped the charges.

Again, a few unfortunate events, I have NEVER been convicted of a crime.

Can anyone provide any insight as to whether arrests play into obtaining a CCW or is it based solely on convictions?

Sounds like you're speaking from experience.

With all due respect, if I was the person who had to decide on your CCWP, I would deny it. Period/end of story. Not only am I 71 years old and never have been arrested, I do not even know anyone who has been arrested. As said in the above quote--for whatever reason you attract trouble and seem to have an anger problem.

Thanks for your input and concerns.

Why did you let it lapse? That alone indicates you may not be serious about it. The rest of the story might be viewed as adding even more doubt about your credibility and intentions.

Per Idaho law, you would have had to have been convicted of misdemeanor domestic violence to not get it.. so likely, you are in the clear if the laws are similar.

You're jumping to conclusions. Maybe his wife was like you - after all, he said the charges were dismissed...

(And he had a gun "at his disposal,” which was returned to him.)

I did carry daily for several years. This was mainly due to the type of job (service work) in some pretty rough locations, as I frequently carried large amounts of $$$ and tools/equipment. I changed professions (went back to college), and frankly did not feel like I needed to carry anymore.

Back to your original question.... you MIGHT have a problem:

What is the definition of a “proper person” to be licensed?
35-47-1-7 Sec. 7. "Proper person" means a person who:
(1) does not have a conviction for resisting law enforcement under IC 35-44-3-3
within five (5) years before the person applies for a license or permit under this chapter;
(2) does not have a conviction for a crime for which the person could have been
sentenced for more than one (1) year;
(3) does not have a conviction for a crime of domestic violence (as defined in
IC 35-41-1-6.3), unless a court has restored the person's right to possess a firearm
under IC 3-7-13-5;
(4) is not prohibited by a court order from possessing a handgun;
(5) does not have a record of being an alcohol or drug abuser as defined in this
chapter;
(6) does not have documented evidence which would give rise to a reasonable
belief that the person has a propensity for violent or emotionally unstable conduct;

(7) does not make a false statement of material fact on the person's application;
(8) does not have a conviction for any crime involving an inability to safely handle a
handgun;
(9) does not have a conviction for violation of the provisions of this article within
five (5) years of the person's application; or
(10) does not have an adjudication as a delinquent child for an act that would be a
felony if committed by an adult, if the person applying for a license or permit under this
chapter is less than twenty-three (23) years of age.

So, it looks like it might hinge upon the reasonableness of the agency issuing the permit in regards to past arrests, even though there were no convictions.

Contact an attorney familiar with 2nd amendment law. Most attorneys will give a free consultation and so it's nothing but a time investment initially...

Man, you people are way too judgmental. He has every right to his CCW. When the law agency does a background on him they are concerned with felony and certain misdemeanor "convictions". When ever it asks if you were ever "convicted" of any offense then you can honestly answer NO if what you say is true. They are also concerned with habitual drug addicts, drunkards and whether or not you were ever admitted to a mental institution. Just because someone has been arrested doesn't make them automatically ineligible nor does it make them a violent or untrustworthy individual with a firearm however if one tends to have a temper then they should know their limits and avoid situations and/or people that evoke that behavior.

IN is shall issue, if you have no convictions you shouldn't have an issue. It will most likely be questioned but if you weren't convicted of a crime, your not DQ'd.

You sound like a liberal bed wetting, nanny state living welfare check recipient with more time to play Internet troll than work! You don't even own a gun, let alone qualify as someone who should be giving advice to others on carrying one. This forum is wise to your deceptive practices. Can't you go play somewhere else, like a busy highway?

Hit the nail on the head with that post!

Thank you to everyone for your help and advice. I am still waiting. I have recently purchased a few new firearms with a delayed status related to my previous arrests, which is something I never had to deal with before, and I felt it.... believe me.

Cheers to all!

I will continue to update!
