Is there anyway a person can get a background check before trying to purchase a pistol?
 
You can get it, but if your state has a waiting period, pre-doing the background check won't let you skip the waiting period. And your state might also have a law that requires purchase-time background checks.

Here in Oregon, background checks are very fast. The last weapon I bought was purchased on a Saturday at 8 PM, and the background check took only about two minutes by phone.
 
Background checks

When you purchase a gun they don't do a full scale background check. The dealer calls the Feds (sounds like it is run through the FBI). They verify you aren't a felon or a terrorist. It takes longer to fill out the application. Now In Minnesota you have to apply for a permit to purchase handguns. That is more in depth and takes a couple of weeks.
 
I know in my state you have to choose the actual firearm you want before getting a background check because they put the firearm info on the background check paperwork. If you fill out a background check and got approved, and you decided you wanted a different gun, you have to start all over.
 
What's nice in SC is when you have a CWP, there is no background check and the info you filled out stays with the seller.

Same goes here in Ky. Gun shops love to see that CCW card because they can get the sale done very fast. Couple minuted is all it takes to purchase a new firearm.
 
One of the reasons I love Kentucky

My Kentucky CCDW license number goes where ATF approval control number goes. Nice knowing no more waiting oddly enough for long guns. Never an issue getting handguns... I blame 12 years of being stationed in Alamogordo, NM.
 
What's nice in SC is when you have a CWP, there is no background check and the info you filled out stays with the seller.

In Kansas we have the same setup with CCW permits allowing a FFL to skip the background check. However, it is up to the seller and most small gunshops do background checks to CYA and the only gun retailer that I have seen that allows the skipping of the background check is Cabela's.
 
Why even ask? Do you know how many background checks I had gone through to be able to come and live here? And that not include background checks whenever I buy a gun...I have nothing to hide...or was it really bad that I hit a schoolmate in the head when I was 6 years of age and run to my room next door and act like as if nothing happened? The little boy cried but no one believed him. Should I be scared that that incident will come out of the woodworks and be in the FBI files years later?

Come to think of it...while I am here...are those Mexicans crossing our borders ever gone through any background checks?

If there is no background check, how does the dealer know that there are no current restrictions on your purchase. If I was a dealer, I'd sure want to do one. Just because you were ok when the permit/license was issued doesn't mean you were when you went to buy the gun. Florida does the instant ( Ha ha ha, LOL instant may take 30 minutes to even get thru to them ) background check and denies purchases to about 3500 to 4500 violators per year.

Why go beyond the amount of government interference that is required by law? Don't we have enough problems with the amount of government interference that IS required? To be honest, I would rather give a dealer business who doesn't feel the need to make a phone call for every sale when not required to do so by law simply so they can get a warm and fuzzy feeling inside from the soothing voice of a government employee on the other end of the phone.
 
A gun dealer is not responsible if the permit is in the buyers hands. I would venture that most CWP holders take care, greater care, of their affairs than do some other non permit holding people and stay out of situations.

Permit holders also know, just by attending the CWP class, that if you buy a gun when you know you shouldn't because your permit is about to be revoked, you're in a world of hurt.

Besides, why go the gunshop route if you can't buy a gun by holding a permit or passing a background check when there is Craigs list, Armslist or a Gunshow every other weekend?

My point is that folks who take the time to get the CWP are most likely going to be fine without the background check.

I will allow that circumstances in SC may be different than other states so my comments only reflect the SC example.

So, my point is, those who think that permit holders may be able to skirt the law, why, when it's so easy to get a gun without a permit anyway.

I totally agree with people still calling it in, but I don't make the rules and the rules say that my CCW can surface as a background check enough if an FFL wants to accept it. I don't make the rules, I just comment on them.
 
New York is once again on the cutting edge, as I can see from other posts. We have to buy a handgun, leave it with the dealer, submit the paperwork to the county clerk or sheriff to approve the sale, have them do a NICS check, have a new "amended" permit signed by a judge and mailed back to us with authorization and pick up paperwork for the dealer (purchase order). Then, we go to the dealer we bought the gun from, fill out the federal and state forms, give them the paperwork authorizing the purchase, then have them do another NICS check. Time to complete in southern counties, 45 days if we are lucky. North and West are somewhat better. And, no, I can't move much to my chagrin so please don't suggest that. I'm glad to see some other states let you buy on your CCW. We aren't to be trusted as citizens of NY. Our government needs to tell us what to do. Ask Schumer or Cuomo. They'll agree.

All it takes is a domestic violence charge to shoot down the whole background check. Being cleared one day does not mean you are good the next. It is a last chance to block an illegal purchase.

As in my reply. Just because you were good when you got the permit does not mean you will be the next week, month, year. Military people do get their clearances revoked as an example. Good one day and bad the next. A simple phone call can actually help the holder if they didn't know there was a problem to start with.

Besides, we know all returning military combat veterans are terrorists. :wink:
