Armed carjacker meets armed citizen. Guess who wins?

This is security cam footage from Venezuela, of all places. Carjacker has the initiative initially, intended victim responds with violence of force. Intended victim is apparently locking up his business. Bad guy makes his appearance approximately 33 seconds into the video with weapon drawn. Results are apparently terminal, so if you are squeamish, don't watch it. A possible accomplice also deterred?


Unfortunately, statistics relating specifically to carjackings in the US are hard to come by because they are reported differently across the nation. The closest thing to solid numbers was compiled from 1992 - 1996 by the the National Crime Victimization Survey (NCVS). It indicated that there were about 49,000 carjackings/attempted carjackings each year. Bureau of Justice Statistics indicate that, as of 2003, there were approximately 1.3 carjackings per 10,000 persons nationwide (http://www.bjs.gov/index.cfm?ty=pbdetail&iid=476). if this is anywhere near correct, then carjacking is a prevalent crime.
 
While the video certainly has the right ending, I'm thinking that the last shot or two would have landed the good guy in a cell anywhere in the U.S. since the bad guy was trying to get away by that time...
 
Almost certainly an accomplice. Looked like that silver coupe that drove through the frame slowly then stopped just past the corner was casing him out.

I'm thinking that he would have made a good case for an ongoing threat given that the second person who showed up also appeared to be pulling a firearm. The question becomes, was the defender still engaging the original target at that moment, or were those extra shots actually intended for the accomplice and the first attacker got in the way? At least one shot is clearly directed at the second individual and impacts the wall right in front of him as he scurries back behind the wall. Given what I see in this video, if I am in the defender's position at that moment I assume I am about to face at least two attackers, one of whom is trying to provide cover for the first attacker so that they can continue the attack from a covered position, and I continue shooting until I am absolutely certain that the threat has been neutralized. I will take my chances with a jury. You know the saying - better to be judged by twelve than carried by six.

That's kinda hit and miss here. There have been several instances where armed robbers have been shot trying to run for cover and the defender isn't charged.
