Another one for the courts

Will be interesting to see how it plays out. I'm new to handguns and currently reading a book on carrying. The author says you can't shoot them if they're fleeing - even if their still inside your home. I've always thought you could if they're inside your home inside your home.

In CA, I believe this ol' guy will soon be toast. I'm surprised there's any debate within the cop-shop or DA's Office considering the statements and facts quoted above.
 
Since they already charged the accomplice with murder and haven't charged the elderly man yet, I'm hopeful they won't. Especially since it sounds like they've robbed him before.

During night time, in Texas, you can. When and under what circumstances you are justified to shoot depends entirely upon state law.

Like I've posted before, just because they are fleeing doesn't mean they are no longer a threat. Around here, Central Arkansas, their "M.O." when fleeing is to stick their gun behind them and shoot as they run. They're even known to fire into a crowd after the jump in the getaway vehicle.

This couple probably wasn't a threat as they fled but there isn't anyway to know that until after the fact.

So, was the homeowner in fear for his life? Sure, and pissed off too after being assaulted.

At 80 years old, you cannot defend yourself if you are unarmed from a physical assault from someone half your age. It doesn't matter if they were armed with a gun or just their fist, it was still 2 people in their twenties against one 80yo man.

Slap him on the wrist, tell him not to do it again unless they are still on his lawn, and then give him a Medal but tell him he can only wear it on Sundays and major non-religious holidays, like Labor Day, 4th of July, Killed a Bad Guy Day, etc.

Ok, ok.....I know.....Killed a Bad Guy Day isn't a National Holiday but it should be.

Circuit Court in DC says the ordinance passed prohibiting open carry of gun in DC is not legal and against the 2nd Amendment of the US Constitution.
It will probably be appealed, but let's just hope the Constitution prevails.
 
While I applaud his ability to defend himself, this man is a incredibly unwise. He completely failed rule number one on talking to the police: Don't talk to the police without your lawyer present.

His words transmit a feeling of vengeance, which may not result well for him in court.

On hold for the moment. I think they're wanting to limit who carries.
