Another Case Of C & C Gone Wrong?

I hate playing the "what if" game, because the variations are endless and usually lead in the wrong direction because they are designed to fulfill a predetermined outcome. This is what I call a solution looking for a problem.

The solution is: Carry your weapon in public without using it to needlessly murder people.

The problem is: People are stupid.

You just have to be the smarter person.

Yeah, I can tell you don't like these scenarios, C&L!:biggrin: But, every class/instruction I've ever taken has recommended them. I agree there are endless variations, but I'm not sure I agree they are designed to fulfill a predetermined outcome; fact is, I'm not sure exactly what you mean by that. Anyhoo, I can see the value in looking at various situations and determining ahead of time how I might/should react. Also, I'm interested in other's opinions, for reasons ranging from: 1) I usually learn something; to 2) they represent a "jury of my peers" and so I'm curious as to their take on a particular situation.

And of course,you got the freedom to not participate if you don't like 'em. I don't mind if you do post, but if it's really chapping your ass...

I'm sure i'll have "H" to pay for this but here it goes:

Without seeing video and just from a broad sense of reading the story I do not feel that the man was justified in using lethal force.

I am assuming (I know) that he was not repeatedly punched, but merely hit once. If this is the case he should have driven away AND if he wanted to "stand his ground" should have done so unarmed. Furthermore, I do not feel that unarmed punches justify deadly force without special circumstances such as you're on the ground "mounted" and being pummeled.

I feel it is my duty to myself and others to be proficient with my carry weapon, my unarmed self defense tactics, and as importantly my "verbal de-escalation techniques".

Now i'm not saying that I'm superman but from what I understand of the story (which may be completely wrong) I wouldn't have used force as I do not see the potential for "serious bodily injury or death" from a single punch.

Hey ClearSightTechnical: I agree with your comments 100%. As far a "talking this thread to death", every reply reinforces opinions and decisions I may make. One recent post said "roll up your window"---I do not believe that many if any of the previous posts even mentioned that and yes it is the first order of business that you should be following before you leave the scene and before the idiot tries to escalate the situation with you as you sit in your car with a CCW. I am not the calmest of guys and would like nothing better to "go after" any idiot but I truly believe that this forum, for all the repetitiveness, and the responsible replies that are posted, has definitely heightend and redefined the kind of responsible actions I should and must take when I am driving around with or without my CCW. I truly believe it has put more calm in my demeanor.

The law allows one to use deadly force to prevent imminent "death or serious bodily injury". Depends on the jury's idea of "serious bodily injury". If the guy doing the punching was 100 lbs soaking wet and the shooter was 220, six and a half feet tall it could be a problem.

Hey NC jones: You are right about a difficulty in having a shooter convince a a jury that the 100 lb guy was an imminient threat to the 220 lb guy. Bottom line is still the fact that a punch in the face, even if the 100lb guy is really a 300lb guy, is still not a clear cut case of imminent threat requiring the use of a CCW. It comes down to a very difficult almost instantaneous decision that a CC person must take---bottom line is to avoid the possiblility in the first place. Odds are if a guy wants to punch you in the face, you put yourself in a position for this to happen. I cannot, in 67 years ever remember any case where I put myself in such a difficult position either by beiing in a place common sense inidicated I should not be in, or standing in front of or mouthing off at some abusive idiot; its amazing how a little common sense and controlled hormones will get you out of probably every potential possibility such as the "punch in the face scenario".

I want to learn more about the rights to protect myself and family from intruders. I am very interested in learning more about getting a CCW. The work I perform takes me into empty foreclosed houses. Well, they are supposed to be empty, and either have vagrants squatting in them or evidence of someone having been there prior to my entry. I want to ensure I protect myself and my family, both at home and while on the job. Any guidance would be greatly appreciated. Thanks.

There is brief summary of permit laws and the rights to use lethal force under the "resources" tab on the home page. In short, Ga is a "shall issue" state, and has a "castle Doctrine " (stand your ground) law.

But I strongly suggest that before arming yourself, you learn the specifics of your state and local statutes, and at a minimum, take a certified concealed carry class. Lethal force is very serious business, and I would certainly want more documemted info than what is available on ay BB before I proceeded further.
