I recently sent a letter to Rep Max Thornberry and Senator John Cornyn, both of Texas. The letter consisted of sample legislation that I received from the Tenth Amendment Center. The sample legislation had already been corrected to read State of Texas where appropriate, and would nullify in Texas every federal firearms regulation that had ever been passed, simply because they are illegal regulations (infringement - which goes against the Constitution).
Today I received an answer from Max. Not one mention of the sample legislation. Just the normal condescending political letter that is designed to appease the dissatisfaction of the common man.
Two quotes from his letter: "I do not know the answer, and I do not know if anyone knows the answer yet. I believe the problem is much deeper and more complex than any of the current proposals contemplate. I am concerned that in a rush to do something, there may be an overreaction. We need to take a more thoughtful approach and look at all of the facts in order to avoid unintended consequences." And then, "The Second Amendment to the Constitution establishes a citizen's right to keep and bear arms. I think it is wrong to restrict the self defense rights of law-abiding citizens in support of a policy that does not work. Therefore, we should look to other measures--perhaps within the government, but also within our families, churches, and cultural institutions--for answers."
First off, he seems to not understand that the Constitution did not establish the right for us to keep and bear arms. It recognizes the right.
Secondly, was not the sample letter of legislation a current proposal? It would certainly solve the problems of the gun-free killing-fields in Texas.
Third, this letter makes it appear that he doesn't seem to be one that will stand up for his constituents. Sad. I hope John Cornyn will be different.
 
I have no hope for Cornyn being any better. All I ever get from him is the same template responses.
He also just voted for the "fiscal cliff" bill the Senate and House passed.
 
Well. if Cornyn doesn't follow through, I think it's time that we the people enforce that part of the 10th Amendment that says, "or to the people". That's the reason it was put in the Constitution. This is an adaptation of the 2A Preservation Act, which I sent to Max and John. Would you sign it, if it was put into your hands?

Rights of the People Preservation Act (Note: Page 1 would be filled in by names, addresses and signatures, which would then continue on page 2, and so on)

AN ACT, which shall be known and may be cited as the “Rights of the People Preservation Act.”

To prevent federal infringement on the right to keep and bear arms; nullifying all federal acts in violation of the 2nd Amendment to the Constitution of the United States.

THE PEOPLE OF THE STATE OF TEXAS DO ENACT AS FOLLOWS:

SECTION 1 The People of the State of Texas find that:

A. The 2nd Amendment to the Constitution of the United States reads as follows:
“A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.”

B. The 10th Amendment to the Constitution of the United States reads as follows:
“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

C. All federal acts, laws, orders, rules or regulations regarding firearms are a violation of the 2nd Amendment.

SECTION 2: PROHIBITION ON FEDERAL INFRINGEMENT OF THE RIGHT TO KEEP AND BEAR ARMS

A. The People of the State of Texas declare that all federal acts, laws, orders, rules, regulations – past, present or future – are in violation of the 2nd Amendment to the Constitution of the United States, are not authorized by the Constitution of the United States and violate its true meaning and intent as given by the Founders and Ratifiers, and are hereby declared to be invalid in this state, shall not be recognized by people of this state, are specifically rejected by the people of this state, and shall be considered null and void and of no effect in this state.

B. It shall be the duty of the legislature of this State to adopt and enact any and all measures as may be necessary to prevent the enforcement of any federal acts, laws, orders, rules, or regulations in violation of the 2nd Amendment to the Constitution of the United States.

SECTION 3 EFFECTIVE DATE

A. This act takes effect upon approval by the Governor, or upon approval by majority vote of the people of the great State of Texas, whichever occurs first.

B. A signature upon this document, of a legal resident of the State of Texas, shall constitute an approved vote by the person who places his signature upon it.
 
I still havent heard from my Representatives, I sent kind of a cut and paste email to them all, still no response. I dont have much hope for them to stand in the progun corner being most of them are as liberal as feinstein, but its worth a try
 
The question in my Post #3, is, Would you sign it, if it was put in your hands?
I'm curious if something like this could get off the ground....
 
The NRA is going to be betrayed by several politicians that they supported in previous elections. The simple fact is that politicians lie to get elected. Most are cowards with no core beliefs and virtually no morals. They are ignorant about the constitution and the beliefs of our founders. I am not disappointed by their revised beliefs on gun control because my expectations are so low. The NRA does not show nearly enough critical thinking before making endorsements. In fairness I would have to concede that often there is no good choice available.
