A Police Offer Told me this

You guys told me in a previous post that I won't get a CCW permit (in California) because it's nearly impossible.
So you suggested an "open-carry"..

Well, yesterday an officer told me this..

"Sure, you can open-carry but you'll attract more attention to yourself.
You have the right to discharge your firearm if someone broke-in or is attempting to break into your residence.
If you discharge your firearm outdoors even in a defensive situation, I'd still have to investigate the shoot.
About 60% of the time the person open-carrying is arrested also."

WTF...is there ANY way to defend myself without being arrested then??

dude im from san diego cali and if u open carry u will be arrested, trust me! my family is full of cops and if they saw someone open carrying u would be arrested.

u can open carry in ur house but if u went to walmart im pretty sure u would be busted. im not a cop or lawyer, but imo i would not try it.

good luck to you tho and there are plenty of ways to protect yourself without carrying a gun. i take jiu jitsu and have had some knife training as well. i dont just rely on my gun.

jiu jitsu in los angeles? yeah you've never been here before obviously.

Inform your family in California that open carry is legal...although the firearm can not be loaded...:fie:

I lived in Los Angeles County for 48 years, and never had the need the carry or use a gun, except in the aftermath for the Rodney King crap when we all carried for a week or so.


My business took me all over the county, including south central. Now, would I choose to live there? no. Would I hang there at night, no. But if your neighborhood is so dangerous, move. Don't say you can't, that's a copout. There are plenty of nice California cities you can move to, and the cost of living is the same or lower than crappy south central.
 
even been told by other cops that you would be arrested. im just sayin my .2 cents. heard it from more than one cop and not just family. u want to oc somewhere and not be bothered by any leo's move to az. plus its alot nicer than gangland.
 
seems to me if state law allows open carry then they have no grounds to arrest you...and if they do, you would have grounds to file a lawsuit (which i would do, i'm sure there are some money hungry lawyers in Kali)...that's based on the assumption you can open carry and there are no city ordinances saying otherwise...i'm not familiar with their laws so you would have to do some research first (which is always what you want to do anyway)

I agree. An arrest with no statutory grounds is a good start for a law suit. If these officers had told you you could expect to be detained and questioned about a Man With A Gun (MWAG) complaint, they would be right, but that's different from being arrested.
 
Rather than putting up with people who choose to abuse you because of where you live, read somebody who actually carries openly in California.
I'm sure you'd do better to address any questions directly to him -- he probably has more real facts to share than anybody here:

In the spirit of the OP title: I had a LEO tell my wife that it was illegal to carry a handgun in her car with out a CHL.. I guess this particular LEO hasn't heard of the several laws in Texas that allow this to happen. I am tempted to contact the department that the officer works for and suggest a required remedial class on laws regarding having a handgun by law abiding citizens.

Before the cautions start flying in.. I would be polite and no I do not live in the town or county in question

Get some training on defensive firearm use. Open carry or not there are a couple of things that are almost ALWAYS going to happen in the aftermath of a defensive shooting.

You will be handcuffed.
You WILL be arrested.
Your Firearm will be confiscated as evidence.

Once the facts regarding the shooting are determined you will be released if the defensive use of lethal force is determined to be justified.

You have to understand that in the eyes of law enforcement someone has been shot. That person is either wounded or dead. If wounded it's a case of aggravated assault. If dead a homicide has occurred (someone is dead = homicide). Until the shooting is determined to be justified, they investigate it as a crime. :pleasantry:

Clear and concise! Thanks. Of course anyone here using their weapon would be justified but for the rest it's a sobering reality. Just wish it was easier and less expensive to protect oneself.:-)
