2nd amendment

I still don't understand why we have to have a concealed permit when we have the 2nd amendment ? It clearly states that we have the right to bear arms but we need a license or our gun will be taken away if we don't have the license.

That's a good question for the Supreme Court. There have been federal court rulings that find the right to bear arms does not equate to the right to carry a gun. There have been rulings stating the opposite. The SCOTUS avoided the issue in both Heller and McDonald. They need to take up this issue.

SC has a bill in the house here to allow Constitutional Carry, I hope it passes!!! I like what AZ did a few years ago going this route!

Let's just write a new 2a that stats what all of us Concealed Carry people want. Be able to carry from state to state and that we do have the right to keep and bear arms. In our homes and on our person and that is definitely an individual right!
Now the way it is and in answer to the OP. I'm no scholar but trying to figure this out with common sense. I think the 2a means that the Federal Gov't has no right to stope you from the RTKBA but that the states can regulate it and therefore the need for permits. I am always perplexed by the fact I want the Feds to take precedence over the states and on other topics I think states rights are more important. Maybe that's why lawyers "practice" law because they haven't got it right either and that's usually where our judges come from. Don't beat me up on this but just my $.02.

It can be a tense subject, regarding the Feds & States 2A powers. I am totally in agreement that States make most of the choices, not the feds. However, the 2A is a responsibility the Feds have in securing to the poeple... it wasn't left to the States to secure it. So, it can be a fine line in interpretation of who has the say in 2A laws...

The only problem with that is if the Supreme Court does take up the issue it won't automatically mean they will rule in our favor. I don't know that the potential benefits of a supreme court ruling that upholds the second amendment is worth the risk of a ruling that forces pro-gun states to have to crack down on ownership and possession laws.

What he said. Exactly.

And if the NRA was worth a poop, they would tackle this issue. But they do not. They simply collect your dues and go with the status quo.

Remember all the amendments were written to protect "We the People" from abusive big gov. Unabridged 2nd Amendment.

It may be confusing, but I prefer the states to be in control of concealed carry. Think about it...do you really want the Federal government in control of your right to bear arms? With the constantly changing political climate in Washington, we can see our rights abused in a heart beat.
